Tax payment or tax evasion?
A remediable distance between discipline and irresponsibility

Contradictory criteria, amounts in the millions, and foolish attitudes, mean that income tax declarations in Granma province are a scourge requiring correction from both the law and the citizenry.

GRANMA -. The figure, though in the millions, is not the most alarming problem. It is true that 4.7 million Cuban pesos would generate a little more in terms of social benefit -because that's what the money raised in taxes is for-, but even more striking is the evasive attitude of those who should have contributed this amount. This is the exact amount of money unpaid in the province of Granma by more than 1400 taxpayers who did not declare their income accurately. Furthermore, this represents tax evasion in only two sectors of authorized self-employed workers: transportation and food related services.

The magnitude of the problem is even greater if we take into account that this number means that 92 % of the self-employed (SE) in these two sectors under-reported their income in the process that ended last April 30 at the headquarters of the Oficina Nacional de Administración Tributaria (ONAT) [National Tax Administration Office]. Evidence of the fraud was obtained in an audit of the two activities.


ATTITUDES AND CONCERNS

It is no surprise that in the first year after the implementation of a new tax law there were associated irregularities. This is especially so since for many years there was not an objective tax regime that would have developed an appropriate tax culture in this country. But the generalized determination to circumvent the provisions of the law represents a kind of social indiscipline that needs to be remedied in time. Measures leading to the collective understanding of the universal importance of taxes and ways to collect these are in order. These are needed to quickly overcome the bad perception prevailing among some. 

This is necessary at least in Granma which had a high number of under reports, as demonstrated by the more than 7800 licenses written off this year in all self-employment activities. Many taxpayers attributed the cause of their cancellation to the extremely high tax burden.

Obviously, after the results of the inspection and the detected indiscipline, a process of individual notification of debt followed. According to this process “the taxpayer must pay the money the failed to declare, plus a fine, and a late charge," explains Juan Miguel Cabrales, provincial director of ONAT.

Of course, such a measure now hurts a lot, and has even resulted in some questioning the effectiveness of the audit.

On the subject, Cabrales argues that ONAT has the system, staff, and mechanisms to very accurately monitor any taxpayer. "This is not an action of a day or two, but it can take up to a year of careful study."

"Nor is it a matter of suspicion. In the case of self-employed transporters, ONAT can - through audits - know exactly the average number of daily trips, the number of passengers, and the actual amount charged. In the case of food vendors: the price of their inputs, their customer flow, hours of higher sales etc…,” he said.

In a survey of taxpayers, many argued that the process lacked individualization, “Because it is inconceivable that in a large group of food kiosks all undeclared the same amount and the resulting fines are identical," or, as referred to by some transporters, “The calculated debt is exactly the double of what I declared, and that seems too coincidental."

Others offer very analytical reasoning, such as the food producer-seller Mario Pelegrin, who does not deny the phenomenon of underreporting, and argues the impact on the problem of “the absence of the announced wholesale market for the self-employed, with competitive prices which would allow them to legally and conveniently acquire, and without extra charges, the supplies which, obtained by other means, increases their costs."

However, it must be said that although the country talked about opening a wholesale market when conditions were created, its absence is one reason why food vendors need only justify one half of the supplies used.

On the other hand, we should ask the 8% of taxpayers who did pay in accordance with their income, what was the strategy that allowed them -despite the absence of this option for supplies- to continue providing services and fulfilling their tax obligations.

Juan Manuel Arzuaga, a food retailer, asked for the consideration of less uniform rates, “because what I make here is less than what other colleagues with greater flow of customers make."

In a taxi station in the city of Bayamo, a taxi driver called for the rescue of the primary control ticket issued on departing “which served to accurately account for your trips, price and number of passengers, and could be presented to ONAT inspectors, and even the police. Now there is no way to check."

“Furthermore, it is almost impossible to show proof of all payments which are made to really operate the car - not to mention gasoline, tires, motor, and other expenses- so that they can calculate the 40 % of your declaration as expenses; because we get many of the repairs and spares through other individuals, who sometimes do not have a license, but that is the only way we sometimes can find what we need."


PENALTIES OR SOLUTIONS 

The criteria came with different expressions: some very objective and reasonable, worthy of note for improvement; others more impulsive and misplaced in the heat of the fine imposed.

Most talked about excesses in the calculation of the debt and doubted the procedures, but few denied having underreported their income.

Therefore, this is a situation that demands analysis and solutions. If we must continue encouraging self-employment as a way to boost the economy, it is also a fact that the same economy requires the prevention of tax evasion.

“The extension of self employment,” Cabrales said, “emerged with the need to create new employment opportunities, but it also carries the obligation to pay taxes for the state budget as an economic measure for the benefit of society.”

“Tax administration is not aimed at imposing fines. Many believe that… but its real purpose is to promote discipline in the population. They must understand that paying their taxes is a duty as citizens; it is a conscious exercise. Many subsidized or free public services that the state provides depend on this contribution.

“Granma, for example, is a province with a budget deficit. Taxes are important revenues to help balance this financial relationship as soon as possible, so that the territory can take in more than it spends.”

"People must know that the tax contribution of the self-employed is incorporated into the budget as revenue for the province, and used directly in its territorial interests," says the director of the ONAT.

Other thorny edges – too many - remain to be analyzed before reaching a judgment as close to reality as possible. Let us just mention, for instance, the general dissatisfaction of the population about the increase four, five, or more times, in the prices of transportation in private vehicles.

A fare that was three pesos before is now 20, and one of 5 is now 25 in the same truck. Do these transporters pay in taxes the same as the difference that passengers have had to take from their pockets in such a short time?

In what category of expenses can one register the actual purchase of fuel or pizza flour, if, despite the dozens of trucks circulating and ovens baking all day long, it's common to find gas stations in Granma with zero liters of diesel sold, or authorized stores reporting monthly sales of only five tons of flour?

What about the illegal operator who evades taxes, violates the law and mocks the honest work of the legally registered self-employed?

Maybe there is a lot to correct in the methods of implementing the new law. More dialogue and training are needed; more information about fulfilling tax duties as an act of high public responsibility. Auditing should increasingly gain efficiency in its tasks of imposing order and promoting tax culture. But above all, it is vital that each actor in this effort be involved without cheating, without evasion, without complicity and with total transparency to progress fast towards an economy capable of sustaining our social achievements, and the elevation of the moral and civic stature of Cubans.

¿Aportar o evadir impuestos?

Un trecho remediable entre disciplina e irresponsabilidad

Criterios encontrados, montos millonarios y actitudes insensatas, definen la subdeclaración de ingresos en Granma como un flagelo que requiere corrección desde la ley y la conciencia ciudadana

GRANMA.— La cifra, aunque millonaria, no es lo más alarmante. Cierto es que 4,7 millones de pesos permitirían hacer un poco más en materia de beneficio social, pues para eso es el dinero recaudado por concepto de impuestos; sin embargo, más llamativa es aún la actitud evasiva de quienes debieron aportar ese monto, que es la cantidad exacta de dinero dejado de pagar en la provincia de Granma por la subdeclaración de más de 1 400 contribuyentes de solo dos de las figuras autorizadas al trabajo no estatal: transportistas y elaboradores-vendedores de alimentos.

La magnitud del problema es aún mayor si se toma en cuenta que ese número significa que el 92 % de los trabajadores por cuenta propia (TCP) registrados en estas modalidades, subdeclararon sus ingresos durante el proceso de Declaración Jurada, cerrado el 30 de abril pasado en las sedes de la Oficina Nacional de Administración Tributaria (ONAT); un hecho comprobado tras la fiscalización realizada sobre las dos actividades mencionadas.

ACTITUDES E INQUIETUDES

A nadie sorprende que en el primer año de vigencia de una nueva Ley Tributaria ocurran irregularidades asociadas a ella, máxime cuando fueron tantos los años divorciados de un régimen fiscal objetivo que fertilizara una apropiada cultura en este campo; pero de ahí a la determinación abierta de burlar lo establecido por ley, incorpora otra variante de indisciplina social que necesita ser remediada a tiempo, aunque también con otras conducentes al entendimiento colectivo sobre la importancia universal de los impuestos y los modos de recaudarlos, a fin de superar rápido la mala impresión que parece haber suscitado en algunos.

Al menos en Granma, además de la elevada cifra de subdeclarantes, así lo demuestran las más de 7 800 licencias dadas de baja este año por contribuyentes de todas las actividades, muchos de los cuales atribuyen la causa de su cancelación a las cuantías elevadas de la carga tributaria.

Obviamente, tras los resultados de la inspección y por las indisciplinas detectadas, sobrevino entonces un proceso individual de notificación de deuda, según el cual "el contribuyente debe pagar el dinero dejado de aportar, más una multa y un recargo por mora", explica Juan Miguel Cabrales, director provincial de la ONAT.

Por supuesto que tal medida ahora le duele a muchos, y ha provocado incluso criterios que cuestionan la efectividad de la fiscalización.

Sobre el tema, Cabrales argumenta que la ONAT tiene un sistema con personal, métodos y mecanismos para fiscalizar de manera muy certera a cualquier contribuyente. "No es una acción de uno o pocos días, sino que puede durar hasta un año de estudio minucioso".

"Tampoco es cuestión de sospecha. En el caso de los transportistas, mediante la fiscalización la ONAT puede conocer con exactitud el promedio de viajes diarios, cantidad de pasajeros, importe real cobrado, y en el caso de los vendedores de alimentos, el precio de los surtidos, el flujo de clientes, las horas de más o menos venta, etc.", señala.

En el sondeo entre contribuyentes, muchos alegaron que al proceso le faltó individualización, "pues no se concibe que en una batería de kioscos gastronómicos todos hayan dejado de aportar lo mismo y sean equivalentes las multas", o que, según refieren algunos transportistas, "la deuda calculada sea exactamente el doble de lo que declaré, y eso parece demasiada coincidencia".

Otros aluden razones muy analíticas, como las del elaborador-vendedor de alimentos Mario Pelegrín, quien no niega el fenómeno de las subdeclaraciones, y expone cuánto influye en este sentido "la ausencia del anunciado mercado mayorista para los TCP, con precios ventajosos que les permitan adquirir legalmente, con suficiencia y sin recargos, las materias primas que obtenidas por otras vías encarecen los costos".

No obstante, vale aclarar que si bien el país habló de la apertura de un mercado mayorista cuando estuvieran creadas las condiciones, su ausencia es una de las razones por las cuales el vendedor de alimentos solo debe justificar la mitad de las materias primas usadas.

Por otro lado, habría que preguntar al 8 % que sí pagó en correspondencia con sus ingresos, cuál es la estrategia que les permitió —a pesar de la ausencia de esta opción para adquirir insumos y materias primas— continuar prestando servicios y mantenerse al día en sus obligaciones fiscales.

Juan Manuel Arzuaga, expendedor gastronómico, pide considerar con menos uniformidad las tasas, "porque no es igual lo que yo gano aquí, a lo recaudado por los colegas de otros lugares con mayor flujo de personas".

En una piquera de la ciudad de Bayamo, un taxista abogó por rescatar el control primario que antes permitía un ticket emitido antes de partir, "que te servía para justificar con exactitud frente a la ONAT, los inspectores, y hasta la policía, los viajes dados, el precio y la cantidad de pasajeros; pero ahora no hay modo de comprobarlo".

"Además, es casi un imposible demostrar el por ciento exigido de todos los pagos en los que realmente se incurren para trabajar el carro —por no hablar de gasolina, gomas, motor, viáticos y otros—, a fin de que puedan considerarte el 40 % de lo declarado como gasto; pues muchos de los arreglos y las piezas los resolvemos con otros particulares, que a veces no tienen una patente de respaldo, pero que es donde único encontramos lo que necesitamos".

¿SANCIÓN O SOLUCIÓN?

Los criterios esbozaron diferentes ángulos: unos muy objetivos y razonables, dignos de tener en cuenta para el perfeccionamiento; otros más impulsivos y descolocados, lanzados al calor de la multa impuesta.

La mayoría habló de excesos en el cálculo de la deuda, dudó de los procedimientos, pero muy pocos negaron haber subdeclarado ingresos.

Por tanto, es un hecho que urge colegiar y corregir, pues si por un lado hay que continuar estimulando el trabajo no estatal como vía de dinamizar la economía, lo cierto es que esa misma economía requiere evitar cualquier forma de evasión fiscal.

"La extensión del TCP —argumenta Cabrales— surge entre otras causas por la necesidad de crear nuevas oportunidades de empleo, pero lleva aparejada también la obligación de tributar al presupuesto del Estado como un fin económico en beneficio de toda la sociedad.

"En consonancia, la administración tributaria no tiene como fin poner multas. Muchos creen eso, pero el propósito real es fomentar una disciplina en la población; que se asuma el pago del tributo como deber ciudadano, como ejercicio consciente, pues de él dependen muchos servicios públicos que el Estado ofrece subvencionados o gratuitos.

"Granma, por ejemplo, es una provincia con déficit presupuestario, y los tributos constituyen ingresos importantes para contribuir a equilibrar lo más pronto posible esta relación financiera, conseguir ser un territorio que ingresa más de lo que gasta.

"Hay que saber que ese aporte de los TCP es incorporado al presupuesto como ingreso cedido a la provincia, y se usa directamente en sus intereses territoriales", precisa el directivo de la ONAT.

Otras aristas espinosas —demasiadas— quedan por valorar para llegar a un juicio lo más cercano posible a la realidad. Nada más mencionemos, por poner un ejemplo, la inconformidad general de la población respecto al encarecimiento en cuatro, cinco, o más veces, de los precios del transporte masivo en vehículos particulares.

¿Acaso estos porteadores pagaron en impuestos la misma diferencia que a los viajeros les ha tocado erogar de sus bolsillos en tan poco tiempo, cuando una ruta, antes de tres pesos ahora vale 20, y una de cinco hoy cuesta 25, en el mismo camión?

¿Qué acápite de gastos podrá registrar la compra real de combustible o de harina para pizzas, si a pesar de las decenas de camiones circulando y los hornos encendidos todo el día, es común que en los servicentros de Granma haya jornadas de cero litros de diésel vendidos, o los comercios autorizados reporten ventas mensuales de apenas cinco toneladas del polvo de trigo?

¿Dónde quedan los ilegales que evaden el fisco, burlando la ley y el trabajo honrado de los cuentapropistas legalmente registrados?

Es posible que haya mucho por corregir en los métodos de implementar la nueva ley: que se exploten más el diálogo y la capacitación, que se multiplique la promoción de los deberes fiscales como un acto de alta responsabilidad ciudadana, que la fiscalización sea cada vez más eficiente en su gestión de imponer orden, a la par de sembrar cultura tributaria de un modo creciente; pero sobre todo, es vital que en ese empeño cada actor participe sin trampas, sin evasiones, sin complicidades y con total transparencia a fin de avanzar más rápido, tanto hacia una economía capaz de sostener nuestras conquistas sociales, como hacia la elevación de la talla moral y cívica del cubano.
