We are all sexual beings, and from the moment we are born we have
rights, privileges and duties which we must know in order to defend them
in all circumstances, without hurting others, or being hurt in the
exercise of our everyday living.
However, for many people sexuality is an intimate, non-questionable
space; and when there are conflicts that affect pleasure, they prefer to
face these from cultural stereotypes - often unfair- instead of
resorting to the laws that regulate this area of life, namely the
Código de Familia, Codigo Penal and Codigo Civil [Family, Criminal
and Civilian Laws]
The interpretation of those
documents goes through the subjectivity of the claimant, the accused, or
the judge: from the perception of the seriousness of the facts to the
determination of guilt, everything goes through the prism of gender, the
weight of traditions and the experience they have on the subject.
I remember a case I had to judge
in my capacity of jueza lego (non-professional judge) several
years ago: A young woman accused the father of her children of
harassment (article 284.1 Criminal Law). She had divorced him after a
long history of proven abuse and humiliation, but he had continued
bothering her and saying he would kill her if she dated other men.
The accused (who was twice her height and weight) defended himself,
saying it was an exaggeration on her part to take him to court, because
he loved her very much, was taking care of her, and had not abused her…
he would “only beat her once or twice, as any man would do to his wife”.
To Denounce, or Not to Denounce?
Article 8.1 of the Criminal Law
considers a punishable crime “every socially dangerous action or
omission forbidden by law”, but Article 8.2 adds that if the matter
lacks social danger because of the “scarce impact of its consequences
and the personal conditions of the perpetrator” it is not considered a
crime… And this is the cultural nuance.
For example, among the crimes against the normal development of sexual
relations are: lascivious abuse without intercourse (article 300.1) and
sexual offense (303) that includes harassment with sexual intent,
offenses to decorum by means of obscene actions, indecent exposure or
distribution of pornography.
For those crimes there are punishments of prison time, fines, or both.
These are valid regardless the sex of the perpetrator, but the law
stresses the need for individual analysis of the circumstances.
However, if it is a woman who attempts to get too close to a man, shows
him her genitals, or touches him without his consent, she may be morally
criticized but rarely denounced… and whoever denounces her, risks
ironical questioning of his manhood, sometimes even from the authority
which receives the complaint.
Another example of socio-cultural inequality is related to the piropo
[spontaneous
verbal
expressions, usually of praise, uttered to passing persons, mostly to
women]. This practice is usually
considered an aggression that can be denounced in many countries. In
Cuba it is something normal, part of Cuban idiosyncrasy. How many rude
expressions must we women put up with in the streets! However, making a
complaint never crosses our minds, unless excessive repetition turns it
into harassment.
But if the object of a piropo
is another male, a simple stare can be enough to make him feel offended
in his masculinity with the right to challenge the offender and commit
crimes such as public disturbances, threats or aggressions.
Violated space
One of the most objectionable
practices in sexuality, and perhaps one of the statistically least
registered is rape, that is: the term used in Article 298.1 to describe
“forced intercourse (vaginal or anal) with a woman”. The same action
against a male is named violent pederasty (article 299.1)
The person who rapes a woman
faces a punishment of four to seven years in prison or seven to 15 if
the rape is performed by two or more persons, or if the victim is a girl
between 12 and 14 years of age. However, if the person raped is male the
punishment starts directly in the second tier (7 to 15 years) whether
there was violence or not in the act.
The maximum punishment (15 to 30 years) is applied to both cases if the
perpetrator is aware that he carries a STD, if he has a prior
conviction, or if the action leaves serious physical consequences. Even
without these aggravating elements, the crime is considered extremely
serious if the girl is under 12 and the boy under 14.
Although it is not explicitly stated, intercourse with violence is
punishable even if the person has regular sex with the aggressor,
whether they are legally married or not.
Protected
Environment
Last month a reader asked if
prostitution is a crime considered in the law. In truth, it is not. But
if the person who practices it breaks the rules of social coexistence,
or is inclined to commit punishable acts, or with the action facilitates
commission of crimes by other persons, it falls within the category the
law describes as socially dangerous.
Articles 72 and 73.2 of the Criminal Law says these actions must be
considered by a municipal court which should prescribe educational or
therapeutic measures to protect society from possible consequences.
Therefore what is punishable is the echo of prostitution, not its
exercise.
Among the associated crimes are the use of other persons for sexual
trade or procuring (article 302.1) and corruption of minors for this
purpose (article 310.1) which is one of the more serious crimes against
the development of childhood and youth. In both cases the punishment is
a prison time between seven and 30 years.
A similar punishment (article 311) of two to five years can be given to
fathers, mothers, or tutors who are aware of the prostitution practices,
sex trading, and other objectionable acts performed by minors under
their care, and do not stop them or inform the authorities to receive
their help. There is also a punishment for persons who perform sexual
acts in the presence of minors or who give them or sell to them obscene
products or objects.
It is also considered a crime to
facilitate an illicit abortion without the consent of the pregnant
woman, or in inadequate conditions for this practice (article 267.1).
Crimes against the normal development of the family such as incest (sex
between first- degree relatives), rape (abuse of power or deceit to have
sexual relations with a single teenager between 12 and 16), bigamy and
illegal marriage are described in articles 304 to 307.
Criminal
hormones
Cuban criminal law acknowledges
the fact that the intensity of certain endocrine processes may have a
negative effect on the social behavior of women. Therefore, article 52 d
considers attenuating circumstances the fact that women act under the
influence of “disorders produced by pregnancy, menopause, menstruation
or post partum depression”. In such cases the court may reduce half the
punishment prescribed for the crime, regardless of its nature.

Todas las personas somos seres sexuados y sujetos de derecho desde que
nacemos, con privilegios y obligaciones que deberíamos conocer
cabalmente para defenderlos en cualquier circunstancia, sin lacerar o
ser lacerados en el ejercicio cotidiano de nuestro existir.
Sin embargo, para mucha gente la sexualidad es un espacio íntimo no
cuestionable, y cuando aparecen conflictos que condicionan su disfrute
prefieren enfrentarlos desde estereotipos culturales muchas veces
injustos, en lugar de acudir a las leyes reguladoras de esa esfera de la
vida, como el Código de Familia, el Penal y el Civil.
Incluso la interpretación de esos documentos pasa por la subjetividad de
quien demanda, es demandado o le toca juzgar en cada caso: desde la
percepción de la gravedad de los hechos hasta la determinación de
culpabilidad, todo es atravesado por la mirada del género, el peso de
las tradiciones y la experiencia acumulada en esas lides.
Recuerdo un caso que me tocó deliberar como jueza lego hace algunos años:
Una joven denunció por el delito de amenaza (artículo 284.1 del Código
Penal) al padre de sus hijos, de quien se había divorciado justamente
por una larga historia de abusos y humillaciones. Después de eso vivía
molestándola y gritaba a los cuatro vientos que la mataría si se
relacionaba con otros hombres.
El acusado (que tenía el doble de su tamaño y peso) se defendió diciendo
que era una exageración de ella llevarlo ante el tribunal porque él la
quería mucho, la estaba cuidando y no era verdad que la maltratara… si
acaso le daba «un par de galletas de vez en cuando, como cualquier
hombre hace con su mujer».
¿Denuncio
o no denuncio?
Según el artículo
8.1 del CP se considera delito «toda acción u omisión socialmente
peligrosa prohibida por la ley bajo conminación de una sanción penal»,
pero el artículo 8.2 acota que si el asunto carece de peligrosidad
social «por la escasa entidad de sus consecuencias y las condiciones
personales de su autor» no se tipifica como tal... Y es ahí donde entra
el sesgo cultural.
Por ejemplo, entre los delitos contra el normal desarrollo de las
relaciones sexuales se contemplan el abuso lascivo sin ánimo de contacto
carnal (artículo 300.1) y el ultraje sexual (303) que incluye acoso a
otro con requerimientos sexuales, ofensa al pudor y las buenas
costumbres con exhibiciones o actos obscenos, y producción o puesta en
circulación de materiales de contenido pornográfico.
En esos casos se estipulan sanciones de privación de libertad, multa o
ambas, dando por sentado que todas son válidas cualquiera sea el sexo
del actor, aunque se insiste en el análisis individualizado de las
circunstancias.
Sin embargo, si es una mujer quien insiste en intimar demasiado con un
hombre, le muestra sus genitales o lo roza sin su consentimiento, tal
vez sea criticada moralmente pero es muy raro que la denuncien… y quien
lo hace se expone a irónicos cuestionamientos sobre su hombría, a veces
hasta de parte de la autoridad que recibe la queja.
Otra muestra de inequidad sociocultural tiene que ver con el piropo,
práctica vista como agresión denunciable en numerosos países. En Cuba se
considera algo normal, intrínseco a la idiosincrasia criolla. ¡Cuántas
groserías soportamos las mujeres en la calle sin que se nos ocurra
quejarnos!, a menos que la insistencia lo convierta en acoso.
Pero si el aludido es otro «macho», basta una mirada perdida para
hacerlo sentir agraviado en su masculinidad y con derecho a reclamar al
«atrevido» en cuestión, cayendo incluso en otros delitos como
alteraciones públicas, agresiones o amenazas.
Espacio
violado
Una de las
prácticas más censurables en materia de sexualidad y probablemente de
las menos registradas estadísticamente es la violación, término empleado
para describir «el acceso carnal con una mujer por vía normal o contra
natura», según el artículo 298.1. Similar conducta aplicada contra
varones se nombra pederastia con violencia (artículo 299.1).
Quien viola a una mujer se enfrenta a una sanción de cuatro a siete años
de privación de libertad, que puede subir de siete a 15 si el hecho se
ejecuta con el concurso de dos o más personas, o si es una niña de entre
12 y 14 años de edad. En cambio si el violentado es un varón la pena
empieza directamente por el segundo rango, haya o no violencia excesiva
en el acto.
La pena máxima (de 15 a 30 años) aplica para ambos casos si el ejecutor
se sabe portador de una ITS, si es reincidente o si el hecho deja
secuelas físicas graves. Sin esas agravantes se valora de grave si la
niña es menor de 12 años y el varón menor de 14.
Aunque no se especifique, el coito con violencia es punible aún cuando
la persona tenga sexo regularmente con su agresor, estén o no casados
ante la ley.
Ambiente
protegido
El mes pasado un
lector preguntaba si la prostitución es un delito tipificado, y
ciertamente no lo es, pero si las personas que deciden ejercerla
quebrantan las reglas de convivencia social, se muestran proclives a
cometer hechos sancionables o facilitan con su actuar que otras personas
los cometan, están cayendo en lo que la ley describe como estado de
peligrosidad social.
En los artículos 72 y 73.2 del CP se prevé que tales conductas sean
evaluadas por un tribunal municipal y se dicten medidas educativas o
terapéuticas para proteger a la sociedad de sus consecuencias. Lo
sancionable es entonces el eco de la prostitución, no su práctica.
Entre esos delitos asociados se cuenta el uso de otras personas para el
comercio carnal, o proxenetismo (artículo 302.1) y la corrupción de
menores para este fin (310.1), uno de los delitos más graves contra el
normal desarrollo de la infancia y la juventud. En ambos casos la
sanción aplicable es la privación de libertad en un rango de entre siete
y 30 años.
Igual medida cabe (artículo 311), pero de dos a cinco años, si padres,
madres o tutores están al tanto de prácticas de prostitución, comercio
carnal u otros actos censurables por parte de menores a su cargo, y no
los impiden ni lo comunican a las autoridades para recibir ayuda.
También son penalizados quienes ejecutan actos sexuales en presencia de
menores o les suministran o venden productos comunicativos u otros
objetos de carácter obsceno.
Son también delitos propiciar el aborto ilícito sin consentimiento de la
grávida o en condiciones no adecuadas para esta práctica (artículo
267.1), y los llamados delitos contra el normal desarrollo de la familia
(artículos del 304 al 307), como el incesto (sexo entre parientes de
primer grado), el estupro (abuso de poder o engaño para tener relaciones
con una adolescente soltera de entre 12 y 16 años), la bigamia y el
matrimonio ilegal.
Hormonas
delictivas
El Código Penal
vigente en Cuba reconoce que la intensidad de ciertos procesos
endocrinos puede tener un efecto negativo en la conducta social femenina.
Por eso el artículo 52 inciso d considera como atenuante «el haber
obrado la mujer bajo trastornos producidos por el embarazo, la
menopausia, el período menstrual o el puerperio», casos en los que el
tribunal puede rebajar la sanción hasta la mitad de lo establecido para
el delito en cuestión, cualquiera sea su índole.
