In light of the seriousness of these crimes and their damaging effects in such a strategic field of the country's economy and the conduct of the defendants -marked by the loss of ethical principles and fraudulent behavior- as well as the degree of their involvement in the facts, the court sentenced ALFREDO RAFAEL ZAYAS LOPEZ, ex-deputy minister of the Basic Industry (2004-2007) and former C.E.O. of its Metal Enterprise, to 12 years in prison; RICARDO GONZÁLEZ SÁNCHEZ, ex-deputy minister of the Basic Industry (2001-2004 and 2007-2010) and former head of both the Metal Enterprise's Board of Directors and the aforesaid Project's Steering Committee, to 10 years in prison; ANTONIO ORIZÓN DE LOS REYES BERMÚDEZ, ex-deputy minister of the Basic Industry (1980-1999) and former member of the aforesaid Project's Steering Committee, to 8 years in prison; and CRISTÓBAL DE LA CARIDAD SAAVEDRA MONTERO, ex-director of Marketing for the enterprise CUBANIQUEL and former consultant and adviser to the aforesaid Project, to 6 years in prison, as all four were found guilty of a crime of Acts in Detriment of the Economic Activity or the Hiring Process Also convicted of crimes like Improper Use of Financial and Material Resources and Failure in the Duty to Preserve the Economic Assets of a State Entity were GILBERTO ALFONSO PARRA ROJAS (sentenced to 8 years in prison), ERNESTO COLUMBIÉ SILVERIO and CARLOS GUSTAVO RODÓN FERREIRO (7 years in prison), BISCMARCK ORTIZ JIMÉNEZ (6 years) -all of them Project Managers at the time of the crime- and ORLANDO GONZÁLEZ PÉREZ, deputy manager of the Project's financial operations, to 7 years in prison. Likewise, the court found ALFREDO BARALLOBRE RODRÍGUEZ, deputy manager of Accounting and Finance with the enterprise Moa Nickel S.A., guilty of a crime of Improper Use of Financial and Material Resources and sentenced him to 6 years; ORLANDO CARMENATY OLMO, deputy manager of Production with the same enterprise, to 5 years in prison, and XIOMARA JIMÉNEZ MORRIS, an Occupational Health and Safety specialist with Moa Nickel S.A., to 4 years in prison replaced by the same term of Correctional Work without Imprisonment. The court also deprived all the accused of their public rights and put a lifetime ban on them to exercise the professions and positions they had held until their arrest. During the investigation process and the criminal trial, the defendants enjoyed the legal safeguards established by the national legislation, exercised their right to legal counsel, and were represented by the attorneys they had appointed. Both the defense lawyers and the prosecutors may file an appeal for annulment of the above sentences with the Criminal Courtroom of the People's Supreme Court.

Año 16 / Número 230 Sanciona el Tribunal Provincial Popular de Holguín a varios exdirectivos y exfuncionarios del Ministerio de la Industria Básica La Sala Primera de lo Penal del Tribunal Provincial Popular de Holguín, después de valorar el amplio material probatorio practicado en el juicio oral celebrado en días recientes en esa ciudad, dictó sentencia, sancionando a varios exdirectivos y exfuncionarios del Ministerio de la Industria Básica y de la Empresa CUBANIQUEL por cometer delitos asociados a la corrupción durante el proceso de negociación, contratación y ejecución del Proyecto de expansión de la planta Pedro Soto Alba, ubicada en Moa, para la extracción, refinación y comercialización de níquel y cobalto. En atención a la gravedad de estos hechos y sus nocivas consecuencias en una de las actividades estratégicas para la economía del país, a la conducta de los acusados, caracterizada por la pérdida de valores éticos y la simulación, y al grado de participación de cada uno de ellos, el tribunal sancionó como autores del delito de Actos en perjuicio de la actividad económica o de la contratación a ALFREDO RAFAEL ZAYAS LÓPEZ, exviceministro del Ministerio de la Industria Básica (2004-2007) y director ejecutivo de la Empresa de Metales, a 12 años de privación de libertad; a RICARDO GONZÁLEZ SÁNCHEZ, exviceministro del Ministerio de la Industria Básica (2001-2004) (2007-2010), director de la Junta de Directores de la Empresa de Metales y presidente del Comité de Dirección del Proyecto, a 10 años de privación de libertad; a ANTONIO ORIZÓN DE LOS REYES BERMÚDEZ, exviceministro del Ministerio de la Industria Básica (1980-1999), miembro del Comité de Dirección del Proyecto, a 8 años de privación de libertad; y a CRISTÓBAL DE LA CARIDAD SAAVEDRA MONTERO, director de Negocios de CUBANIQUEL y consultor, asesor y experto del Proyecto, a 6 años de privación de libertad. Igualmente resultaron sancionados como autores de los delitos de Uso indebido de recursos financieros y materiales y de Incumplimiento del deber de preservar los bienes de entidades económicas GILBERTO ALFONSO PARRA ROJAS, a 8 años de privación de libertad; ERNESTO COLUMBIÉ SILVERIO, a 7 años de privación de libertad; CARLOS GUSTAVO RODÓN FERREIRO, a 7 años de privación de libertad; BISCMARCK ORTIZ JIMÉNEZ, a 6 años de privación de libertad, quienes en ocasión de los hechos cometidos se desempeñaban como directores del Proyecto; así como a ORLANDO GONZÁLEZ PÉREZ, subdirector de Finanzas del Proyecto, a quien se le impusieron 7 años de privación de libertad. El Tribunal, de igual forma, consideró autores del delito de Uso indebido de recursos financieros y materiales a ALFREDO BARALLOBRE RODRÍGUEZ, subdirector de Contabilidad y Finanzas de la Empresa Moa Nickel S.A. a quien le impuso la sanción de 6 años de privación de libertad; a ORLANDO CARMENATY OLMO, subdirector de Producción de la Empresa Moa Nickel S.A., sancionado a 5 años de privación de libertad y a XIOMARA JIMÉNEZ MORRIS, especialista de Seguridad y Salud del Trabajo, quien resultó sancionada a 4 años de privación de libertad subsidiada por igual periodo de Trabajo Correccional sin Internamiento. El Tribunal aplicó además a todos los acusados las sanciones accesorias de privación de derechos públicos y prohibición del ejercicio de las profesiones y cargos que desempeñaban al momento de los hechos. Durante la investigación y la realización del juicio oral, los acusados contaron con las garantías establecidas en la legislación procesal penal, ejercieron su derecho a la defensa y fueron representados por los abogados de su elección.
