The same day the
front page of El Nuevo Herald published the five-year jail
sentence for “vertical combatant” of Ernesto Montaner, it also announced
the beginning in Madrid of the trial on the case against the Sintel
Company. It was surprising that both items were published in the
front page of the paper which is –unofficially-- the mouthpiece of the
Miami Cuban extreme-right.
To review a bit of history, we must say that before being officially
accused of Medicare fraud, Montaner had fled the country and gone into
hiding somewhere in Costa Rica. He knew the investigation of his company
was forthcoming and opted to run as fast as he could and seek shelter
away from the United States.
The US justice accused him of embezzlement. He had used false or altered
invoices to steal millions of dollars from the national health system.
Montaner owned several physical therapy clinics in Miami and used these
to commit fraud. FBI agents went to Central America to find him in
January 2011 and he was sentenced a few days ago. The judge disregarded
the letters he received requesting mercy for the defendant on grounds of
reputation, age and health and sentenced him to five years in prison.
Montaner is widely-known in this community, not only because of his
personal history, but also for being a son of the late “poeta del
exilio” Ernesto Montaner, and a brother of the writer and journalist
Carlos Alberto Montaner, one of the “presidential candidates” [for
Cuba’s regime change]
of the Miami Cuban right-wing, and an irreconcilable enemy of Cuba. But
none of this served Montaner’s cause. He is now in jail and will remain
there for several years.
The Sintel case took place outside the United States, in Spain.
In 1996, the Mastec Company of Miami, property of Jorge Mas Canosa and
sons, brought the Sintel telephone company to the point, five
years later, of declaring bankruptcy and leaving 1800 workers unemployed
and hundreds of creditors unable to collect their bills.
It was disclosed during the trial, held only a few days ago in Madrid,
that the Mas Canosas consciously left Sintel without capital by stealing
all the assets of the company. The trial will resume in November this
year.
One could ask why and what action was performed in 2001 which will be
taken to trial more than ten years later. Why have the Spanish courts
taken all these years to do something that both former employees and
creditors had been demanding ever since the embezzlement came to light?
Some say the Spanish government did not want to accuse the Mas Canosas
because of the relevance and political influence they have in the United
States and among the Spanish and Miami extreme right. This is likely to
be true, because, if now Spanish justice considers there is enough
evidence for a trial, there is no reason to think they did not have the
evidence two or three years after the actions took place.
The million- dollar question is whether the sons of the late Jorge Mas
Canosa will go to Madrid and face Spanish justice. In my view, I don’t
think the “patriotic” President of the Junta de Directores de la
Fundación Nacional Cubano Americana [Board
of Directors of the Cuban American National Foundation]
will ever have a pint of beer or a glass of wine in Madrid’s Gran Via.
I don’t believe there is an extradition agreement between Spain and the
United States, but even if there were, I don’t see the slightest
possibility of the authorities in this country extraditing them if they
are found guilty.
Again I must say it is really surprising to see both cases given such
relevance in the local paper, because generally when this kind of news
is published it is well buried in the inner pages.
These characters are the ones who constantly talk about liberating Cuba,
the ones who make speeches next to the Presidents of the United States
and give them warm embraces. These are the guys who philosophize on
representative democracy and market economics. Now we see that they want
a market economy to market it, to corrupt it and loot it, as their
ancestors did in the past in the Cuba they dream of “liberating” today.

El mismo día en que El Nuevo Herald reportó en primera plana la sentencia a cinco años de cárcel al «combatiente vertical» Ernesto Montaner, también anunció que se iniciaba en Madrid una vista oral sobre el caso de la compañía Sintel. La verdad es que llama la atención que ambas informaciones hayan sido publicadas, y más en la primera plana de ese rotativo que es, extraoficialmente, el vocero de la ultraderecha cubanomiamense.
Haciendo un poco de historia, hay que decir que Montaner, antes de ser oficialmente acusado de fraude al Medicare, se fugó del país y fue a ocultarse en algún lugar de Costa Rica. Sabía que la investigación sobre su compañía estaba en camino y optó por salir, como alma que lleva el diablo, a buscar refugio fuera de Estados Unidos.
La justicia de este país lo acusó de haber desfalcado, mediante facturas falsas o alteradas, millones de dólares al sistema de salud nacional. Montaner tenía varias clínicas de terapia física en Miami y a través de las mismas cometió los fraudes. Allá a Centroamérica fueron los agentes del FBI a buscarlo, en enero de 2011, y lo condenaron hace unos días. El juez no tuvo en consideración las cartas que recibió para que tuviera clemencia con el acusado, debido a su reputación, su edad y su salud, y lo sentenció a la mencionada condena.
Montaner es una persona ampliamente conocida en esta comunidad, no solamente por su historial sino también por ser hijo del llamado «poeta del exilio», de su mismo nombre, ya fallecido, y hermano de Carlos Alberto Montaner, escritor y periodista, uno de los «presidenciables» de la derecha cubana en Miami y enemigo acérrimo de Cuba. Pues de nada le valió a Ernesto, quien en la cárcel estaba y en la cárcel estará por varios años.
El caso de Sintel fue un hecho que sucedió fuera de los Estados Unidos, en España. En 1996 la compañía Mastec de Miami, propiedad de Jorge Mas Canosa y sus hijos, compró esa compañía telefónica para, cinco años más tarde, declararla en quiebra, dejando más de 1 800 empleados en la calle y sin trabajo, así como centenares de acreedores sin poder cobrar sus cuentas.
Según se supo en la vista oral llevada a cabo hace solo unos días en Madrid, los Mas Canosas descapitalizaron conscientemente a Sintel, robándose todos los activos que esta poseía. El juicio oral se llevará a cabo en noviembre próximo.
Hay que preguntarse por qué un acto que fue llevado a cabo en el 2001 va a ir a juicio más de una década después. ¿Por qué las Cortes españolas se han tomado todos estos años para realizar algo que tanto los antiguos empleados como los acreedores estaban pidiéndole desde el mismo día que salió a la luz pública tal desfalco?
Algunos afirman que el Gobierno español no quería acusar a los Mas Canosas por la relevancia e influencia política que estos tienen en Estados Unidos y dentro de la ultraderecha española y miamense. Es muy posible que eso sea cierto pues si en estos momentos la justicia española considera que hay suficientes evidencias para realizar un juicio, no habría razón alguna para que dos o tres años después de lo que ocurrió no hubieran existido.
La pregunta de los sesenta mil pesos es si los hijos del fallecido Jorge Mas Canosa irán a Madrid a comparecer ante la justicia española. A mi modo de verlo, creo que el «patriota» presidente de la Junta de Directores de la Fundación Nacional Cubanoamericana no se vuelve a tomar ni una caña ni un chato de vino en la Gran Vía de Madrid.
No creo que exista ningún tratado de extradición entre España y Estados Unidos pero, aunque existiera, no veo la menor posibilidad de que, si son encontrados culpables, las autoridades de este país los llegaran a extraditar.
Vuelvo a decir que es sumamente curioso que ambos casos gozaran de la relevancia que tuvieron en el periódico local, ya que generalmente aquí esas noticias, en caso de que sean publicadas, salen bien escondidas en las páginas interiores.
Estos personajes son los que constantemente se llenan la boca para hablar de la libertad de Cuba, los que hacen discursos junto a los presidentes de Estados Unidos, los que se abrazan con ellos. Son los que filosofan de democracia representativa, economía de mercado, etc. Ahora vemos que quieren la economía de mercado para mercadear la economía, para corromperla y saquearla, como lo hicieron sus antepasados hace años atrás en la Cuba que hoy sueñan «liberar».
