ANOTHER ILLEGAL ASSASSINATION

International law strongly condemns the assassination of heads of state or government. Human consciousness accepts this only in cases of legitimate popular insurrections when the abused masses, lacking other means to put an end to an oppressive regime, feel compelled to do it for the sake of justice. The assassination of the head of state or government of a foreign country outside the boundaries of a legal system is in any circumstance a universally-condemned crime.

The killing promoted by NATO of the Head of State of the Libyan (Jamahiriya) Republic, Col. Muammar Khadafi, fulfills all the requisites of an assassination.

Whether he was killed in combat or murdered when he was helpless, whether this was an act of war in violation or not of the Geneva Convention, whether it was an act of justice or a flagrant violation of human rights, whether he died in some kind of skirmish or was executed after his capture; all of it is arguable. But only through an overwhelming manipulation of global media - which has already started -the criminal culpability of US imperialism promoted by the leaders of servile European oligarchies can the overthrow and later homicide of Khadafi be justified.

The Prime Minister, imposed on Libya by the occupying NATO forces, first reported that Khadafi had been badly hurt in the head during a shooting, while other sources from the same National Transition Council declared he had bled out on his way to the hospital, or that he had been murdered by soldiers after his capture.

The home videos published at first show Khadafi alive, as he was being placed in a van, hit and insulted while the Libyan leader, covered in blood, resisted, yelled and struggled. In another video from a cell phone Khadafi is seen dead on the pavement. In another, the corpse is seen exposed in a cold storage room and then paraded as a trophy over the hood of a car along the streets of Misrata.

The long history of US manipulations and lies under similar circumstances made many observers refuse to swallow the versions circulated by the international corporate press with its multimillionaire resources and advanced technology.

Several distrustful observers rejected the crude version spread by many western media that presents a handsome "Libyan hero", wearing a New York Yankees cap and holding a smoking gun, as he claims to be the author of the killing. This is how such media started giving shape to a version that would eventually free the real criminals from the responsibility for the prisoner's execution.

There are still many aspects to clarify concerning the way the Libyan leader died, and there might be a formal national or international investigation requested by the UN Human Rights Council, and perhaps even a further action by the International Criminal Court.

But the fact is that the US, with or without NATO's shelter, has granted itself the right to carry out the illegal execution of non-complying leaders, despite the words in its Constitution that specify that even the worst murderer must not be punished without being condemned in a court of law.

Today there are still those who, due to the inconsistencies in the several videos that show obvious tampering and photographic tricks, believe the death of Kadafi is a lie.

For the famous French journalist Thierry Meyssan, President of the Voltaire Network, "this militarily useless murder has not been performed as an example but rather as an effort to fracture the structure of Libyan tribal society." In fact, the leaders of NATO's intervention coalition admitted that the operation was not aimed at applying and enforcing UN Security Council Resolution 1973, but rather at doing away with a political system and killing its leader without taking him to the International Criminal Court.

This second aim was because the International Criminal Court would not have been able to condemn him for crimes against humanity without evidence, as was the case of the Serbian leader Slobodan Milosevic who, after two years of trial, died in prison under mysterious circumstances.

It remains to be seen whether the Libyan patriotic forces that survived the invasion are able to keep harassing the authors of the coup and hinder the handing out of the riches of the Libyan people to the foreign aggressors. That would also obstruct new predatory acts against the Third World.

OTRO MAGNICIDIO EXTRAJUDICIAL

El derecho internacional condena firmemente el magnicidio y la conciencia humana solo lo admite en casos de insurrección popular legítima en la que las masas populares abusadas e impedidas de poner fin por otros caminos a un régimen opresor se ven obligadas a apelar a ello para hacer justicia. La ejecución extrajudicial de un jefe de Estado o gobierno de un país extranjero, sin embargo, es en cualquier circunstancia un crimen condenado universalmente.

El asesinato del Jefe del Estado de la República de Masas (Jamahiriya) de Libia, Coronel Muammar Khadafi, propiciado por la OTAN reúne todos los requisitos para ser calificado de magnicidio.

Se puede discutir si fue muerto en combate o asesinado en condiciones de indefensión; si fue un acto de guerra violatorio o no del tratado de Ginebra; si fue un ajusticiamiento o hubo violación expresa de los derechos humanos; si murió tras alguna forma de enfrentamiento o ejecutado tras su captura. Pero solo mediante una abrumadora manipulación global de los medios -que ya se ha iniciado- podrá disimularse la culpabilidad criminal del imperialismo estadounidense, propiciada por los líderes de las oligarquías europeas que le son serviles, en el derrocamiento y posterior homicidio de Khadafi.

El primer ministro impuesto en Libia por las fuerzas ocupantes de la OTAN había informado en un primer momento que Khadafi había sido gravemente en la cabeza durante un tiroteo, en tanto otras fuentes del propio Consejo Nacional de Transición aseguraron que se desangró camino al hospital o que fue asesinado por soldados después de su captura.

Los videos caseros que inicialmente se publicaron muestran a Khadafi con vida, cuando era subido por la fuerza al vagón de una camioneta, golpeándolo y vilipendiándolo, mientras el líder libio, ensangrentado, les oponía resistencia vociferando y forcejeando con ellos. En otro video de teléfono celular se muestra a Kadafi, ya sin vida, sobre el pavimento. También vio el cadáver exhibido en un frigorífico de Misrata y luego paseado como trofeo sobre el capot de un auto por las calles de esa localidad.

El amplio historial estadounidense de manipulaciones y mentiras en circunstancias similares hizo que muchos observadores se resistieran a aceptar tranquilamente las versiones puestas en circulación por la prensa corporativa internacional con sus multimillonarios recursos económicos y avanzada tecnología.

Varios suspicaces observadores rechazaron por burda la versión difundida por muchos medios occidentales en la que se presenta a un bien parecido joven “héroe libio” con una gorra deportiva de los New York Yanquis y un pistola recién disparada, reclamando ser autor personal del asesinato, conformando una versión destinada a servir de base para excluir a los verdaderos criminales de responsabilidad por la ejecución del prisionero.

Aún quedan por definir muchas cuestiones relativas a la forma en que murió el líder libio y quizás haya una investigación formal a nivel nacional o internacional dispuesta por el Consejo de Derechos Humanos de la ONU o se llegue a una acción de la Corte Penal Internacional
(CPI).

Pero el hecho consumado es que Estados Unidos, con escudo de la OTAN o sin él, esta acreditando como su derecho legítimo, las ejecuciones extrajudiciales contra los dirigentes que le son incómodos, cuando hasta la Constitución de EEUU especifica que ni el peor asesino puede ser castigado sin haber sido condenado por un tribunal.

No han faltado quienes, a partir de abundantes inconsistencias en los videos mostrados que evidencian montajes y adulteraciones muy obvias, consideran -aún hoy- que es falsa la muerte de Kadafi.

Para el célebre periodista francés y presidente de la Red Voltaire, Thierry Meyssan, “este asesinato militarmente inútil ha sido perpetrado más que para servir de ejemplo, para desestructurar la sociedad tribal libia”. De hecho, los dirigentes de la Coalición interventora de la OTAN, al llevarla a cabo, admiten que la operación no tenía como finalidad hacer respetar y aplicar la Resolución 1973 del Consejo de Seguridad de la ONU, sino derribar un sistema político y matar a su líder sin llevarlo ante la Corte Penal Internacional.

Esto último porque no habrían podido condenarlo por crímenes contra la humanidad a falta de pruebas, como les sucedió ante el Tribunal Penal Internacional con el del líder serbio Slobodan Milosevic, quien luego de dos años de proceso murió en prisión, en circunstancias misteriosas.

Ahora habrá que ver si las fuerzas patrióticas libias que hayan sobrevivido la invasión serán capaces que mantener en jaque a los golpistas para entorpecer la entrega de las riquezas que son del pueblo libio al agresor extranjero para así obstaculizarle nuevas depredaciones contra el Tercer Mundo.
