The Constitution of 1940, a Milestone in the Cuban Legal Tradition
The Constitution of 1940—one of the most advanced of its era—went into
effect just 70 years ago.

Seventy years ago, on July 1, 1940, most of the delegates to the
Constitutional Assembly who had drawn up and approved the new
Constitution met in Guáimaro to sign it there, at the same place where,
in April 1869, Cuba’s first constitution, which marked the birth of the
Republic in Arms—with its elected authorities and a juridical framework
for its institutions—had been approved.
The fact that the Constitution of 1940 was signed in Guáimaro and was to
go into effect on October 10 that year emphasized that the new text was
to become part of the Cuban nation’s rich juridical tradition. This
hasn’t always been brought out and given the study it deserves. Its
approval was linked to two key elements of that tradition: the decrees
abolishing slavery that Carlos Manuel de Céspedes issued in the
liberated city of Bayamo after the uprising at La Demajagua and the
April 1869 Guáimaro Constitution.
Now, we are celebrating the 70th anniversary of the passage of that
constitutional text, which was of key importance in the political and
juridical processes of the 1940s and ’50s.
One of the Most Progressive Constitutions of its Time
We
should keep in mind that, as a political reflection associated with the
outbreak of World War II in 1939, a peaceful process was promoted in
which all of the political forces in the country took part. With
national consensus, the most advanced aspects of political thinking of
the era were expressed in the constitution of 1940. This text was a
result of the historic process that began in the time of Julio Antonio
Mella and included the Student Directorate and the revolutionary
activities of Antonio Guiteras.
The period that followed its adoption up to March 1952, when Fulgencio
Batista pulled his coup d’etat, was that of Authentic Party
administrations (those of Grau San Martín and Carlos Prío Socarrás),
which became symbols of corruption, venality, theft, gangsterism and
subordination to U.S. policies.
In spite of these serious weaknesses, which stemmed from the prevailing
social system, the n of 1940 constitution was one of the most
progressive capitalist constitutions of its time, one of the ones
closest to advanced social thinking in the western nations. Of course,
its most progressive measures were never put into practice, because the
corrupt, sell-out administrations prevented this. The later struggle to
implement and respect it was the starting point of a process that would
lead us to socialism.
Sinew of National Rebellion
The
defense of that constitutional text had a decisive influence on the
struggle against the tyranny. That struggle was based on the juridical
tradition already mentioned, which was very clearly exemplified in two
things frin the neocolonial period (1902-59). During that historic
period, the constitutional order was trampled underfoot twice by the
installation of a tyranny: that of Gerardo Machado (1927-33), with the
extension of powers, and that of Fulgencio Batista (1952-58), following
the coup. Both generated radical revolutionary processes based on
struggling against the breaking of the law. The people’s refusal to
accept those tyrannical, illegitimate administrations lies at the heart
of Cuba’s political and juridical heritage.
A general election had been called for June 1, 1952, and everything
indicated that a party with a broad popular base would win it. On March
10, less than three months before the election, Fulgencio Batista
overthrew the Constitutional government with U.S. support and abolished
the f 1940 constitution, thus preventing the people’s victory and
strengthening United States control of the Cuban economy.
In 1953, Fidel Castro and the others who attacked the Moncada Garrison
proclaimed the juridical principles of the Cuban nation and denounced
those who had crushed the country’s juridical system. The struggle
against Batista’s illegal regime meant fighting for the 1940
constitution of 1940 and bringing the topic of legality to the
foreground. That’s how the struggle against the tyranny began.
In History Will Absolve Me, Fidel based himself on the precepts
of the 1940 constitution—especially the one that declared national
resistance against infringements of the Constitution to be valid—for
implementing the most important revolutionary measures.
That constitution contained key elements of Cuba’s legal principles; no
other document expressed them more clearly.
This Constitution and its application are a part of the philosophical
and social history of our country and also of the best and purest
universal cultural tradition.
Lessons of History
History once again gave a lesson to the reactionaries and to
imperialism, because the people’s rejection of that tyrannical regime
generated a radical revolutionary process that wound up with the triumph
of the Revolution on January 1, 1959, with which we won complete freedom
and independence.
In its development, the Revolution went farther than the 1940
constitution, but that constitution has always been one of our most
cherished memories. It expressed Cuban political thinking of the 1940s
that had been achieved through public consensus and formalized by the
Constitutional Assembly, whose members included both figures of the
right-wing and outstanding representatives of the Communists and of the
revolutionary forces that had fought against Machado.
Emilio Núñez Portuondo, Carlos Márquez Sterling, José Manuel Cortina and
Alfredo Hornedo were among the representatives of bourgeois conservative
thinking; the revolutionary, progressive leaders included Blas Roca,
Eduardo Chibás, Salvador García Agüero and Juan Marinello.
While the constitutional text was being approved, the workers—mobilized
by the workers’ organization headed by Lázaro Peña [the Central de
Trabajadores de Cuba, or Workers' Central Union of Cuba]—massed around
the Capitolio, playing an important role in bringing pressure to bear
during the debates.
Professor Julio Fernández Bulté
has pointed out, the constitution of 1940 was the first constitution in
Latin America to establish economic and social rights as well as
civil and political ones. It recognized the workers’ right to strike,
declared work to be an inalienable right of man, outlawed discrimination
based on sex or color, established special protection for families and
women’s equality, and supported free general education and public health
care for all.
Even though the advanced nature of the 1940 constitution is
unquestionable, the country’s political and economic system at the time
made it impossible to implement the most revolutionary of the measures
contained in it. For example, one of the key provisions called for the
abolition of large landholdings. Obviously, this couldn’t be put into
practice: the system prevented it. It wasn’t until the Revolution
triumphed on January 1, 1959, that this could be accomplished.
Experience showed that large landholdings in the hands of the most
reactionary circles in Cuba and of large U.S. consortia forced us to
clash with imperialism.
After the triumph of the Revolution, the first important law enacted was
the Agrarian Reform Law, which put an end to the system of large
landholdings. This was followed by an accelerated process of
revolutionary radicalization, and other nationalizing measures were
proclaimed, but it was the Agrarian Reform Law that determined the
course of the Revolution and caused the United States to express its
opposition to the Revolution with concrete actions, including the Bay of
Pigs invasion.
Juridically Consecrating the People’s Rights
The
Revolution that triumphed in 1959 was the product of a people’s armed
insurrection, and some people have tried to hide the facts that it was
carried out in strict observance of Cuba’s juridical tradition and that
it has Latin-American and universal scope.
To understand the new paths that Cuba, Our America and the rest of the
world have taken to save ourselves from the universal holocaust with
which we are threatened, I invite jurists and all men and women of
cultural sensitivity to keep in mind that, in Cuba, the Revolution
triumphed by means of an armed insurrection after the March 10, 1952,
coup had destroyed juridical order and abolished the 1940 constitution,
one of the most advanced in the world 70 years ago.
In modern times, the enormous importance of legality in the political
life of nations has been brought out dramatically once again by the
events that have taken place in Venezuela, Bolivia and Ecuador to give
those countries Constitutions that express the people’s aspirations and
by the coup in Honduras. Historically, it has always been the
counterrevolution and the reactionary classes of Latin America that have
ignored the law while cynically trying to present themselves as
standard-bearers of legality. This is why it is so important, in this
continent, to defend a juridical tradition that consecrates the people’s
rights and their institutions.
The most important, pressing political task of our time is to defend
ethics and law. This is directly linked to the actions that must be
taken to meet the enormous challenges with which the Cuban nation is
faced. We live in a world in which inequalities, infringements of
international law, the threat of nuclear war, attacks and the systematic
destruction of the environment threaten to put an end to our species and
to all other species on Earth. With this cause, we can join the great
movement which Fidel has convoked in favor of peace, to halt the
machinery of war which, if not stopped, may lead to a confrontation with
incalculable consequences and the destruction of all that man has
achieved throughout his long history.

Hace ya siete décadas se reunían en Guáimaro, el 1ro. de julio de 1940,
la mayoría de los constituyentistas que habían redactado y aprobado la
nueva Constitución para firmarla allí, en aquel escenario histórico
donde en abril de 1869 se había aprobado la primera Constitución, que
marcó el nacimiento de la República en armas con sus autoridades
elegidas y dotada de un marco jurídico para sus instituciones.
El hecho de que la Constitución de 1940 fuese firmada en Guáimaro y se
dispusiera su entrada en vigor el 10 de octubre de ese propio año,
subraya el interés de insertar el nuevo texto constitucional en la rica
tradición jurídica de la nación cubana, no siempre divulgada y estudiada
como merece. Su aprobación se vincula, por tanto, a dos momentos
esenciales de esa tradición: los decretos aboliendo la esclavitud
dictados por Céspedes en la ciudad libre de Bayamo, después del
alzamiento en la Demajagua, y la Constitución de Guáimaro en abril de
1869.
Estamos rememorando, pues, el aniversario 70 de la aprobación de ese
texto constitucional que tuvo un significado clave en los procesos
políticos y jurídicos de las décadas del 40 y el 50 del pasado siglo.
Una de
las más progresistas de su tiempo
Recordemos que
como reflejo político asociado al estallido de la Segunda Guerra
Mundial, en 1939, se propició un proceso de carácter pacífico en el que
intervinieron todas las fuerzas políticas del país para plasmar en la
Constitución de 1940, con el consenso nacional, los puntos más avanzados
del pensamiento político de la época. Su texto es el resultado histórico
del proceso forjado desde los tiempos de Mella y el Directorio
Estudiantil y la acción revolucionaria de Antonio Guiteras.
El período que siguió a su aprobación hasta el golpe de estado de
Fulgencio Batista en marzo de 1952, fue el de los llamados gobiernos
auténticos con Grau San Martín y Carlos Prío Socarrás, que devinieron
símbolos de la corrupción, la venalidad, el latrocinio, el gangsterismo
y la subordinación a la política norteamericana.
No obstante estas profundas debilidades derivadas del sistema social
dominante, la Carta Magna de 1940 fue una de las más progresistas de su
tiempo entre los países capitalistas. Entre las naciones del llamado
Occidente, fue una de las más cercanas a un pensamiento social avanzado.
Desde luego, sus medidas más progresistas nunca se cumplieron porque los
gobiernos corrompidos y entreguistas lo impedían. La lucha posterior por
hacerla cumplir y respetar fue el punto de partida de un proceso que nos
conduciría al socialismo.
Nervio de
la rebeldía nacional
La defensa de ese
texto constitucional influyó, de manera decisiva, en la lucha contra la
tiranía. Ello tenía su fundamento en la tradición jurídica mencionada y
que se ejemplificó, de manera muy evidente, en dos momentos del período
neocolonial (1902-1959). En ese período histórico, en dos ocasiones fue
violentado el orden constitucional instaurándose una tiranía: la de
Gerardo Machado (1927-1933), con la prórroga de poderes; y la de
Fulgencio Batista (1952-1958), a partir del golpe de Estado. Ambos
generaron procesos revolucionarios radicales, que tuvieron como
fundamento la lucha contra el quebrantamiento de la ley. El rechazo
popular a la ilegitimidad de gobiernos tiránicos está en la médula de la
cultura jurídica y política cubana.
Para el 1ro. de junio de 1952 se habían convocado elecciones generales,
en las cuales iba a triunfar un partido de amplia base popular. Menos de
tres meses antes, el 10 de marzo de aquel año, Fulgencio Batista, con el
apoyo norteamericano, derrocó al gobierno constitucional y abolió la
Constitución de 1940. De esta forma, impidió la victoria popular y
afianzó el dominio de Estados Unidos en el terreno económico del país.
En 1953, Fidel y los moncadistas proclamaron los principios jurídicos de
la nación cubana y denunciaron a los que habían quebrantado el sistema
jurídico del país. La lucha contra el régimen ilegal de Batista
significó combatir a favor de la Constitución de 1940 y plantearse el
tema de lo jurídico en un primer plano. Así comenzó la lucha contra la
tiranía.
Fidel, en La Historia me absolverá, se apoya textualmente, para
la aplicación de las medidas revolucionarias más importantes, en
preceptos de la Constitución de 1940 y en especial en el que validaba la
resistencia nacional frente a las violaciones de la misma.
Contiene elementos esenciales de esta cultura jurídica de la nación
cubana; ningún otro documento lo expresa con mayor nitidez.
Esta Constitución y su aplicación consecuente están insertadas en la
historia filosófica y social de nuestro país y forma parte, además, de
la mejor y más depurada tradición cultural universal.
Lecciones
de la historia
La historia
nuevamente dio una lección a los reaccionarios y al imperialismo porque
el rechazo del pueblo a aquel régimen tiránico generó un proceso
revolucionario radical que culminó con el triunfo de la Revolución, el
1ro. de enero de 1959, con la que conquistamos la plena libertad y la
independencia.
La Revolución, en su desarrollo, rebasó el marco de la Constitución de
1940, pero ella ha constituido siempre una de nuestras sagradas memorias.
Expresa el pensamiento político cubano de la década del 40 logrado por
consenso público y formalizado por la Asamblea Constituyente, en la que
estuvieron presentes tanto figuras de la derecha como una destacada
representación de los comunistas y de las fuerzas revolucionarias
provenientes de la lucha contra Machado.
Como representantes de un pensamiento conservador burgués sobresalen
Emilio Núñez Portuondo, Carlos Márquez Sterling, José Manuel Cortina o
Alfredo Hornedo, entre otros, y en el campo de las fuerzas
revolucionarias y progresistas habría que mencionar a Blas Roca, Eduardo
Chibás, Salvador García Agüero y Juan Marinello.
Durante el proceso de aprobación del texto constitucional se mantuvieron
movilizaciones de obreros convocados por la organización de los
trabajadores, liderada por Lázaro Peña, en torno del Capitolio, que jugó
un importante papel como elemento de presión durante los debates. Como
ha señalado el siempre recordado profesor Julio Fernández Bulté, la
Constitución del 40 fue la primera en América Latina en establecer los
derechos económicos y sociales junto a los civiles y políticos.
Reconoció el derecho de los obreros a la huelga, declaró el trabajo como
un derecho inalienable del hombre, proscribió la discriminación racial
por motivo de sexo o color, estableció la protección especial a la
familia y a la igualdad de la mujer, se pronunció por la educación
general y gratuita, por la salud pública al alcance de todos.
Aunque es incuestionable el carácter avanzado del texto constitucional
aprobado en 1940, sin embargo, el sistema económico y político dominante
en el país hacía imposible llevar a la práctica las disposiciones más
revolucionarias contenidas en la Constitución de la República. Para
citar una de ellas, que resulta clave, disponía la abolición del
latifundio. Esto, obviamente, no pudo instrumentarse: el sistema vigente
lo impedía. Fue solo la Revolución triunfante el 1ro. de enero de 1959
la que logró hacerlo.
La vida demostró que el obstáculo del latifundio en manos de los
círculos más reaccionarios del país y de los grandes consorcios
norteamericanos nos obligó a chocar concretamente con el imperialismo.
Tras el triunfo revolucionario, la primera y fundamental legislación fue
la Reforma Agraria y, por tanto, la extinción del latifundio. Se generó
a partir de entonces un acelerado proceso de radicalización
revolucionaria y fueron proclamadas otras medidas nacionalizadoras, pero
fue la ley agraria lo que en definitiva determinó el curso de la
Revolución y originó, en última instancia, que Estados Unidos comenzara
a concretar su acción, incluso armada en Girón, contra la Revolución.
Consagrar
jurídicamente los derechos del pueblo
Como la
Revolución triunfante en 1959 fue producto de una insurrección armada
popular, hay quienes pretenden escamotear el hecho de que ella se llevó
a cabo con apego a la tradición jurídica nacional cubana y que posee
alcance latinoamericano y universal.
Si se quieren entender los nuevos caminos de Cuba, nuestra América y el
mundo para salvarnos del holocausto universal que nos amenaza, invito a
los juristas y a los hombres y mujeres de más alta sensibilidad cultural
a tomar en cuenta que en Cuba la Revolución triunfó por la vía de la
insurrección armada a partir de que el golpe de Estado del 10 de marzo
de 1952 quebrantó el orden jurídico y abolió la Constitución de 1940,
una de las más avanzadas del mundo de hace 70 años.
En nuestros días, los procesos que han tenido lugar en Venezuela, en
Bolivia, en Ecuador, para dotar a esos países de textos constitucionales
que plasmaran las aspiraciones populares y el golpe de Estado en
Honduras, ponen de manifiesto dramáticamente, una vez más, la enorme
importancia de la juridicidad en la vida política de las naciones.
Históricamente, han sido siempre la contrarrevolución y las clases
reaccionarias de América Latina las que se han colocado al margen de la
legalidad y, sin embargo, han pretendido presentarse, cínicamente, con
las banderas del derecho. De ahí la importancia de asumir en este
continente la defensa de una tradición jurídica que consagre los
derechos del pueblo y de sus instituciones.
No hay tarea política más importante e inmediata en nuestros días que
asumir la defensa de la ética y el derecho. Ella se
vincula directamente con las acciones que es necesario desplegar para
hacer frente a los colosales desafíos que hoy tiene ante sí la nación
cubana, inserta en un mundo en el que las desigualdades, las violaciones
del derecho internacional, el peligro de guerra nuclear, las agresiones
y la destrucción sistemática del medio ambiente amenazan con poner fin a
la vida de nuestra especie y de las demás especies en el planeta Tierra.
Es una bandera con la que podemos sumarnos al gran movimiento convocado
por Fidel a favor de la paz y para detener la maquinaria de guerra en
marcha que podría desatar una confrontación de incalculables
consecuencias y conducirnos a la destrucción de toda la obra acumulada
por el hombre a través de su dilatada historia.
