Relatives of the pilots ask Obama to not release Cuban spy

The letter was sent to Obama on 24 February, coinciding with the fourteenth anniversary of the shootdown.

"We'd like to meet with you to discuss our opposition to a prisoner exchange with Cuba that includes Gerardo Hernandez," the letter said.

Hernandez, leader of the Wasp Network, was the only one of five Cuban agents who was blamed for the downing of the planes. He has received two life sentences plus 15 years in prison in Victorville, California.

The text recalled the validity of an indictment against the Cuban officers who committed murder and should be brought in U.S. courts.

The White House responded by email June 15, informing family members that the president could not join them because of his busy schedule.

Kuhly Maggie Alejandre, sister of Armando Alejandre, said she was disappointed by the lack of responsiveness to the request of Washington family.

The Cuban-American lawyer Jose Pertierra, a strong advocate for the release of the five, insisted that President Obama has absolute power to grant executive clemency, derived from the United States Constitution.

"The Justice Department has an office dedicated to evaluating possible recommendations for presidential pardon or executive clemency, and may, in its discretion, ask the alleged victim of a crime their opinion," said Pertierra. The Cuban regime launched a media campaign for the release of Hernandez few days after 13 July when the first batch release of Cuban political prisoners of the Black Spring of 2003 following a tripartite agreement with the Catholic Church and the government of Spain .

Cuban Parliament President Ricardo Alarcon, said Hernandez was confined to a punishment cell, suffers from hypertension and was infected with a bacteria that circulate among the prison population.

- Familiares de los pilotos de Hermanos al Rescate derribados en 1996 solicitaron al presidente  Barack Obama que desestime un posible canje de prisioneros con Cuba en favor del agente Gerardo Hernández, condenado por espionaje en Estados Unidos.

“A las familias de las víctimas nos preocupa que con futuros cambios en las relaciones entre Estados Unidos y Cuba se deje de lado la justicia para nuestros seres queridos”, indica una carta enviada a la Casa Blanca por las familias de Carlos Costa, Armando Alejandre Jr., Mario De la Peña y Pablo Morales.

Los pormenores de la petición salen a la luz en momentos en que el gobierno cubano ha lanzado una intensa campaña internacional por la liberación de Hernández, de 45 años, supuestamente sometido a maltratos y con serios padecimientos de salud.

La carta fue enviada a Obama el pasado 24 de febrero,  coincidiendo con el décimocuarto aniversario del derribo de las avionetas.

“Nos gustaría reunirnos con usted para discutir nuestra oposición al intercambio de prisioneros con Cuba que incluya a Gerardo Hernández”, agrega la
misiva.

Hernández, líder de la Red Avispa, fue el único de cinco agentes cubanos a quien se le responsabilizó por el derribo de las avionetas. Cumple dos condenas a cadena perpetua más 15 años en la cárcel de Victorville, California.

El texto recordó la vigencia de un encausamiento contra los oficiales cubanos que cometieron el asesinato y que deberán ser traídos ante la justicia estadounidense.

La Casa Blanca respondió mediante un correo electrónico el 15 de junio, comunicándole a los familiares que el presidente no podría reunirse con ellos a causa de su apretada agenda.

Maggie Kuhly Alejandre, hermana de Armando Alejandre, dijo sentirse decepcionada por la poca receptividad de Washington hacia la petición familiar.

“Es preocupante que la Casa Blanca nos dé la espalda en momentos en que Cuba ha intensificado su campaña para poner a Estados Unidos como chivo expiatorio de sus males y sacar a primeros planos el caso de Gerardo Hernández”, dijo Kuhly a CaféFuerte.
