Posada or the past

The attempt to present Luis Posada Carriles as an exemplary patriot and anti-Castro fighter, which some exiles in Miami have been trying to do for years, reveals a vision that is out of date and stuck in an era that has already disappeared, which – from the standpoint of emotion – can be explained by the frustration and years of waiting that, despite the intentions and illusions of these exiles, has not led to the disappearance of the regime in Havana.

The reality is that Washington used Posada Carriles for various undercover activities, in an era when the use of certain violent means was kept secret and was not penalized as is the case now. And it is also a fact that the movement created by Fidel Castro took part in terrorist acts from its beginnings, and then with its arrival into power his government supported, trained, and provided resources and protection to people who committed murder, planted bombs, carried out kidnappings and carried out such diverse and multiple acts of force one could assemble an encyclopedia of violations and violence. Nonetheless, violence cannot be justified by violence. In this sense, at least, we have made substantial progress in recent years.

The cold war has ended. The worldwide condemnation of the use of torture and other illegal and inhuman measures to destroy the enemies of this nation is another example of the ever growing rejection of political justifications for the murder of civilians and acts that endanger the lives of innocents.

Posada Carriles has become a relic of another era, and of course his entry into the United States led to a hypocritical stance by a government that inherited a tradition that it accepted – albeit sometimes undercover – of carrying out sabotage and acts of terror to attack the enemy. But condemning this hypocrisy must not serve as a justification for evil deeds.

This situation of seeming negligence and lack of interest, which at times led to suspicions of complicity and cover-up, has begun to change with the administration of Barack Obama.

The new legal proceedings against Posada must be weighed within the proceedings now being brought against him for lying to the immigration authorities. The charges of perjury are added to other previous charges of lying on his application for U.S. citizenship about how he entered the United States. Another charge that has been added, and that has great importance, is obstructing a federal investigation of “international terrorism.” For the first time, he is being linked to the bombs placed in tourist facilities in Cuba between 1997 and 1998, which led to the death of an Italian tourist.

This marks a small advance, but it leads one to think that there is greater willingness on the part of the federal prosecutors and the grand jury to solve this case and not leave it unsettled.

A federal grand jury is investigating Posada’s alleged participation in raising funds for this campaign of dynamite attacks among Cuban exiles living in Union City, although no charges have been placed in this regard. Posada has always stated his innocence regarding these accusations.

The investigation seemed to take on new energy after Posada’s illegal entry into this country, but it has confronted many obstacles, including the fact that the FBI office in Miami destroyed important evidence in the Fall of 2003.

The destroyed evidence was part of a previous investigation concerning the attacks on tourist facilities in Cuba. Included were Western Union cables and money transfers. In November 2006, the FBI confirmed that some documents were destroyed, but at the same time it denied any irregularities. The officials described this as a routine procedure, authorized by the Department of Justice, once it closed the case in 2003 due to lack of progress in the investigation.

The new indictment seems to indicate, at the least, progress in collecting evidence regarding the explosive attacks, which caused the death of Italian Fabio di Celmo in the Hotel Copacabana in Havana.

Luis Posada Carriles has a long resume – some made public, some still kept secret – that disqualifies him as a patriot and fighter for democracy. He is an individual who has acted outside the law for most of his existence, without stopping to weigh the consequences of his acts on the lives of innocent beings.

One might argue that the regime in Havana is manipulating the case of Posada Carriles for propagandistic ends and that it lacks the moral standing to present itself as a champion of antiterrorism. But this should not have any bearing on the investigation of his alleged participation in activities like the dynamite attacks carried out in Havana.

Many actions in the course of Posada Carriles’s career merit the same condemnation as the campaign of sabotage carried out by the July 26 Movement and the Revolutionary Directorate to bring down the dictatorship of Fulgencio Batista.

There is no justification for placing bombs in movie theatres, parks, and hotels. Terror is not a morally or legally appropriate weapon, whether it is used against a dictator like Batista or against a totalitarian regime like the one that governs Cuba.

The legal proceedings against Posada Carriles must be expanded and should not be limited to an immigration case. Clearing up his possible participation in the dynamite attacks is now more necessary than ever, as a demonstration of a real change in Washington and as proof that we are living in an era where terrorism has lost its ideological justifications.

Posada o el pasado

El intento de presentar a Luis Posada Carriles como un patriota ejemplar y combatiente anticastrista, algo en lo que desde hace años están empeñados algunos exiliados en Miami, revela una visión caduca y un atrincheramiento en una época ya desaparecida, la cual --desde el punto de vista emocional-- se explica por las frustraciones y años de espera que, pese a los intentos e ilusiones de esos mismos exiliados, no han conducido a la desaparición del régimen de La Habana.

La realidad es que Washington utilizó a Posada Carriles para diversas actividades encubiertas, en una época en que el empleo de ciertos medios violentos se mantuvo en secreto y no se sancionó como ahora. Y es un hecho también que el movimiento creado por Fidel Castro participó en actos terroristas desde sus inicios y luego, con la llegada al poder, su gobierno apoyó, adiestró y dio recursos y amparo a personas que cometieron asesinatos, colocaron bombas, realizaron secuestros e hicieron tan diversos y múltiples actos por la fuerza, que podría escribirse una enciclopedia de violación y violencia. Sin embargo, la violencia no se justifica con la violencia. Al menos, en este sentido, hemos avanzado sustancialmente en los últimos años.

La guerra fría terminó. La repulsa mundial al empleo de la tortura y otros medios ilegales e inhumanos, para destruir a los enemigos de esta nación, es una muestra más de que cada vez es mayor el rechazo a las justificaciones políticas para los asesinatos de civiles y los actos que ponen en peligro la vida de inocentes.

Posada Carriles se ha convertido en un rezago de otra época, y por supuesto que desde su entrada a Estados Unidos hubo una gran hipocresía, por parte de un gobierno heredero de una tradición que admitía --aunque a veces a escondidas-- la realización de sabotajes y actos terroristas con tal de atacar al enemigo. Pero condenar esta hipocresía no debe servir para una justificación de lo mal hecho.

Esta situación de aparente negligencia y falta de interés, que por momentos llevó a sospechar de complicidad y encubrimiento, ha comenzado a cambiar con la administración de Barack Obama.

El nuevo enjuiciamiento contra Posada hay que considerarlo dentro del proceso que se le sigue por mentir a las autoridades de inmigración. Los cargos de perjurio se añaden a otros previos que lo acusaban de mentir, en su solicitud de la ciudadanía norteamericana, sobre la vía utilizada para entrar a Estados Unidos. Otro cargo que se ha agregado, y que tiene una gran importancia, es el de obstruir una investigación federal sobre ''terrorismo internacional''. Por primera vez, se le vincula con las bombas colocadas en instalaciones turísticas de Cuba, entre 1997 y 1998, que tuvieron como consecuencia la muerte de un turista italiano.

Se trata de un pequeño avance, pero que hace pensar en una mayor voluntad, por parte de la fiscalía federal y el jurado de instrucción, en resolver este caso y no diluirlo en indefiniciones.

Un jurado de instrucción federal está investigando la supuesta participación de Posada en la recaudación de fondos para esa campaña de atentados dinamiteros, entre exiliados cubanos residentes en Union City, aunque no se han presentado cargos al respecto. Posada siempre se ha declarado inocente respecto a esas acusaciones.

La investigación pareció cobrar un nuevo impulso luego de la entrada ilegal de Posada en este país, pero ha enfrentado múltiples obstáculos, entre ellos, que la oficina del FBI en Miami destruyó importantes pruebas en el otoño del 2003.

Las pruebas destruidas fueron parte de una investigación previa sobre los ataques a las instalaciones turísticas en Cuba. Entre éstas había cables de la Western Union y transferencias de dinero. En noviembre del 2006, el FBI confirmó que algunos documentos fueron destruidos, pero al mismo tiempo negó la existencia de irregularidades. Los funcionarios declararon que se trató de un procedimiento rutinario, autorizado por el Departamento de Justicia, luego que ésta cerrara el caso en agosto del 2003 por la ausencia de progreso en la investigación.

El nuevo encausamiento parece indicar, al menos, un avance en la recopilación de pruebas sobre los atentados con explosivos, que causaron la muerte del italiano Fabio di Celmo en el Hotel Copacabana de La Habana.

Luis Posada Carriles tiene un amplio historial --en parte hecho público, en parte mantenido aún en secreto-- que lo descalifica como patriota y luchador por la democracia. Es un individuo que la mayor parte de su existencia ha actuado al margen de la ley, sin detenerse a medir las consecuencias de sus actos en las vidas de seres inocentes.

Se puede argumentar que el régimen de La Habana manipula el caso de Posada Carriles con fines propagandísticos y que carece de moral para presentarse como un paladín del antiterrorismo. Pero ello no impide que se deba investigar la supuesta participación de éste en actividades como los atentados dinamiteros ocurridos en La Habana

Muchos actos en la trayectoria de Posada Carriles merecen la misma repulsa que la campaña de sabotajes llevada a cabo por el Movimiento 26 de Julio y el Directorio Revolucionario, para poner fin a la dictadura de Fulgencio Batista.

No hay justificación para colocar bombas en cines, parques y hoteles. El terror no es un arma adecuada ni moral ni legal, ya sea utilizada contra un dictador como Batista o contra un régimen totalitario como el que gobierna Cuba.

El proceso contra Posada Carriles debe extenderse y no limitarse a un caso de inmigración. Aclarar su posible participación en los atentados dinamiteros es ahora más necesario que nunca, como una demostración de un cambio real en Washington y una prueba de que vivimos en una época donde el terrorismo ha perdido sus justificaciones ideológicas.
