FIDEL CASTRO RUZ, President of the Council of State of the
Republic of Cuba.
BE IT KNOWN: That the Council of State has agreed upon the following:
WHEREAS: Humanity lives in the silent horror of a real war that recognizes no
borders, generated by the illegal drug trade that is growing unrestrained as a
global threat, that affects every corner of the planet and hundreds of millions
of addicted users, at the same time that it engenders violence, corruption,
social instability, ungovernability, insecurity, deterioration of physical and
mental health, and money laundering, among other ills.
WHEREAS: Cuba, as a member of the international community, also faces ever
greater threats and perils from this phenomenon, as shown by the recent growth
in the rate of use, although minor in comparison with other nations.
WHEREAS: The ownership of houses and lands by citizens is the result of
revolutionary labors benefiting working people, and it is therefore unacceptable
that unscrupulous people take advantage of these benefits and use them in
activities for profit and personal enrichment to the detriment of the common
well-being and of the moral values of our society.
WHEREAS: It is well known that on occasions, foreigners coming to our country
are found transporting drugs destined for other countries and even developing an
internal market for those substances, violating the established regulations for
their stay in this country, organizing their operations from rented houses, many
of which are illegal,
WHEREAS: The struggle against drugs in our country is consistent with the
extraordinary humanist and binding values that the Revolution has forged, and
is part of the endeavor to constantly dignify the human being and to create a
vital general culture as a real and infinite step in building a new society. In
this confrontation, we will employ the necessary juridical instruments and
continue utilizing resources despite our economic limitations to combat
international drug trafficking and the incipient internal market to the death.
WHEREAS: Such serious and harmful acts against the life and health of the
people, especially adolescents and young people, who are particularly vulnerable
to such criminal behavior, can only be confronted with drastic and exemplary
measures.
WHEREAS: It is equally necessary, within the framework of the law, to combat
with greater rigor and energy other manifestations of corruption and antisocial
conduct that noticeably affects our society and that involve the use of houses
or s and lands.
THEREFORE: The Council of State, acting on the authority conferred on it under
clause c) of Article 90 of the Constitution of the Republic, proclaims the
following:
LAW-DECREE No. 232 CONCERNING CONFISCATIONS FOR ACTIONS RELATED TO DRUGS,
CORRUPTION, OR OTHER ILLICIT ACTS.
SECTION I: CONFISCATION OF HOUSES OR COMMERCIAL SPACES
ARTICLE 1.-The confiscation or loss of the respective rights to
houses or commercial space is authorized for those who:
a) produce, traffic in, acquire, store, consume, hide or by any other means
carry out, directly or indirectly, acts related to illicit drugs, narcotics,
psychotropic substances or other substances that produce similar effects;
b) engage in acts of corruption, prostitution, trafficking in prostitutes,
procuring, pornography, corruption of minors, traffic in persons, or similar
acts;
ARTICLE 2.1.-Confiscations referred to in the previous article may be ordered in
cases where the legal owner of a house or commercial space has:
a) rented out the house or commercial space without duly registering it or,
having registered it, failing to inform the authorities about said rental
according to the established legal procedures;
b) given lodging to a person who commits any of the acts described in the
previous article, providing that the occasion or circumstances that led to the
acts indicate, or permit the reasonable assumption that the owner had knowledge
of or was an accomplice in such acts;
c) used the house or commercial space or any part of them as a clandestine
discotheque, videoteque, brothel, or for other purposes in which the acts
referred to in the previous article are practiced.
2.-When the acts mentioned in Article 1 are carried out by a renter, tenant, or
occupant of a house or commercial space, acting in any of the ways referred to
in that article, such persons shall be deprived of the corresponding rights.
ARTICLE 3.-When appropriate, the Attorney General and the Minister of the
Interior shall inform the Provincial Director of Housing of the particulars
necessary to act in these cases.
ARTICLE 4.1. - Instructions providing for the confiscation or loss of rights to
a house or commercial space shall be issued by the Provincial Director of
Housing or by the special municipality Isla de la Juventud, within seven working
days from the date when the acts in question were first discovered.
2. – Reviews of an instruction referred to in the previous clause shall only be
brought before the President of the National Institute of Housing. The review
shall take place within three working days following the date of the
notification of the contested instruction, without interrupting the execution of
the confiscation process.
3. - In case of a review, there shall be no administrative or judicial remedy
recognized against the decision handed down by the President of the National
Institute of Housing
ARTICLE 5. - In carrying out the dispositions in the previous article, the
housing authorities shall be assisted by the National Revolutionary Police to
preserve public order.
ARTICLE 6.- The assets referred to in this section are understood as any house
that serves as permanent or temporary shelter, as well as the enclosed rooms of
which they form a part, and the spaces, roofs, patios, and, enclosed gardens
contiguous with it or giving access to its interior..
SECTION II: CONFISCATION OF LAND AND AGRICULTURAL ASSETS
ARTICLE 7.1.-Consfiscation shall be ordered of lands and agricultural assets of
any owner who:
a) cultivates the cannabis idica, known as marihuana, or other plants of similar
properties;
b) Conceals, transport, or traffics in any type of drugs,
narcotics, psychotropic substances, or substances of similar effect.
2.-When acts referred to in the previous clause are committed by a tenant, that
person shall forfeit both the right to use that land as well as the agricultural
assets.
3.-Notwithstanding the dispositions in the previous clauses,
assets that are indispensable to satisfy the vital necessities of the delinquent
or of the dependent family members of the delinquent shall be exempted from
confiscation.
ARTICLE 8.-Confiscation of land and agricultural assets and the loss of the
right of possession of land, will also apply when the acts referred to in the
previous article are committed by persons who are not the owners, provided that
the occasion or circumstances in which said acts are carried out permits the
reasonable conclusion that the acts were committed with the knowledge of the
owner or the occupant of the land.
ARTICLE 9.1.-When acts stipulated in Article 7.1 are committed within the
property of an Agricultural Production Cooperative, the delinquent shall
forfeit the corresponding rights and a heavy economic penalty shall be levied
against the cooperative because of its tolerance, negligence or lack of
vigilance and control over said property.
2.-If the acts occurred at a Basic Unit of Production
Cooperative, the same procedure as indicated in the previous clause shall be
followed.
ARTICLE 10.1.-The order for the confiscation or loss of the right to possess
lands shall be issued by the Land Agent of the Ministry of Agriculture within a
period of seven working days from the date the acts referred to in Article 7.1
were discovered.
2. - An order, as mentioned in the previous clause, may be reviewed only by the
Minister of Agriculture.

3.-The review shall take place within three working says
following the date the order was issued but may not interrupt execution of the
confiscation process.
4.-In case of a review, there shall be no administrative or judicial remedy
recognized against the ruling made by the Ministry of Agriculture.
ARTICLE 11.-For the purposes of this Law-Decree, animals, facilities, crops,
equipment, or tools used in agricultural production, liquidated assets and
mortgage obligations, and houses are considered agricultural property.
FINAL DISPOSITIONS
FIRST: The dispositions contained in this Law-Decree shall be applied without
prejudice to the penalties that might be ordered against the accused.
SECOND: Confiscated properties shall be disposed of in the manner most useful
from the socio-economic point of view and in a timely fashion.
THIRD: The Attorney General of the Republic, in the exercise of the functions
established in Article 127 of the Constitution of the Republic, shall supervise
and manage the effective and rapid execution of the measures and steps set forth
in this Law-Decree.
FOURTH: The Minster of the Interior, the Minister of Agriculture, and the
President of the National Institute of Housing shall be authorized to issue the
orders and instructions necessary within their own jurisdiction to insure the
fullest implementation of the terms set forth in this Law-Decree.
FIFTH: This Law-Decree shall go into effect on the date of its
publication in the Official Gazette of the Republic. Any law or regulation that
conflicts with this Law-Decree shall be repealed.
GIVEN in the Palace of the Revolution, in the City of Havana, on the

HAGO SABER: Que el Consejo de Estado ha acordado lo siguiente:
POR CUANTO: La humanidad vive el horror silencioso de una verdadera guerra que
desconoce fronteras, generada por el comercio ilegal de drogas, que se expande
indeteniblemente como una amenaza global, afecta todos los rincones del planeta
y a centenares de millones de consumidores habituales, al tiempo que engendra
violencia, corrupción, inestabilidad social, ingobernabilidad, inseguridad,
deterioro de la salud física y mental del hombre y lavado de dinero, entre otros
males.
POR CUANTO: Cuba, como integrante de la comunidad internacional también se
enfrenta a amenazas y riesgos cada vez mayores, provenientes de ese fenómeno, lo
que se evidencia en que últimamente el uso indebido de drogas muestra índices
crecientes, aunque discretos en comparación con otras naciones.
POR CUANTO: La propiedad de los ciudadanos sobre la vivienda y las tierras
constituye el resultado de la obra revolucionaria en beneficio del pueblo
trabajador, es inaceptable que personas inescrupulosas se aprovechen de estas
conquistas y las utilicen en actividades de lucro y enriquecimiento personal, en
detrimento del bienestar común y de los valores morales de nuestra sociedad.
POR CUANTO: Es conocido que ocasionalmente son detectados ciudadanos extranjeros
que arriban a nuestro país transportando drogas con destino a otros países e
incluso para fomentar el mercado interno de esas sustancias, organizando sus
operaciones desde casas de alquiler, muchas de ellas ilegales, violando las
regulaciones establecidas para la estancia de extranjeros en el país.
POR CUANTO: La lucha contra las drogas en nuestro país es consustancial a los
extraordinarios valores humanistas y solidarios que ha forjado la Revolución; es
parte de la vocación por dignificar cada vez más al ser humano y del propósito
por lograr una cultura general integral como obra verdadera e infinita en la
edificación de una sociedad nueva. En ese enfrentamiento, se utilizarán los
instrumentos jurídicos que resulten necesarios y se seguirán utilizando los
recursos que hagan falta, a pesar de nuestras limitaciones económicas, para el
combate a muerte contra el narcotráfico internacional y el incipiente mercado
interno.
POR CUANTO: Tan graves y nocivos actos contra la salud y la vida de los
ciudadanos y del pueblo, especialmente adolescentes y jóvenes, particularmente
vulnerables a tales acciones criminales, solo pueden enfrentarse mediante
medidas drásticas y ejemplarizantes. POR CUANTO: Es necesario igualmente, en el
marco de nuestra legalidad, combatir con mayor rigor y energía otras
manifestaciones de corrupción y conductas antisociales, que afectan
sensiblemente a nuestra sociedad, en las que son utilizadas viviendas o locales
y la tierra.
POR TANTO: El Consejo de Estado, en uso de las atribuciones que le han sido
conferidas por el inciso c) del Artículo 90 de la Constitución de la República,
dicta el siguiente:
DECRETO-LEY No. 232 SOBRE CONFISCACION POR HECHOS RELACIONADOS CON LAS DROGAS,
ACTOS DE CORRUPCION O CON OTROS COMPORTAMIENTOS ILICITOS
CAPITULO I CONFISCACION DE VIVIENDAS O LOCALES
ARTICULO 1.-Se dispone la confiscación o, en su caso la pérdida
del respectivo derecho de las viviendas o locales, en los que:
a) se produzca, trafique, adquiera, guarde, consuma, oculte o de cualquier otro
modo se realicen hechos que, directa o indirectamente, se hallen relacionados
con las drogas ilícitas, estupefacientes, sustancias psicotrópicas u otras de
efectos similares;
b) se practiquen actos de corrupción, prostitución, proxenetismo,
trata de personas, pornografía, corrupción de menores, tráfico de personas u
otros de similar connotación.
ARTICULO 2.1.-La confiscación a que se refiere el artículo anterior `podrá
disponerse cuando se trate del propietario legal de la vivienda o local,
comprendiéndose también los casos en que el propietario haya:
a) arrendado la vivienda o local sin hallarse inscripto en los registros
correspondientes o que hallándose inscripto no informe a las autoridades dicho
arrendamiento dentro del término legalmente establecido;
b) albergado en la vivienda a un tercero que comete los hechos previstos en el
artículo anterior, siempre que la ocasión o las circunstancias concurrentes
evidencien o hagan suponer racionalmente que el titular tiene conocimiento o
relación con los hechos;
c) dedicado la vivienda o el local o parte de ellos a discotecas o videotecas
clandestinas, casas de citas, o a otras actividades en que se practiquen los
hechos a que se refiere el artículo anterior.
2.-Cuando los hechos enunciados en el artículo 1 sean realizados por algún
arrendatario, usufructuario u ocupante de la vivienda o del local, actuando de
alguna de las formas a que se refiere el apartado anterior, se dispondrá la
pérdida del respectivo derecho.
ARTICULO 3.-La Fiscalía y el Ministerio del Interior, en su caso, pondrán en
conocimiento del Director Provincial de la Vivienda los elementos necesarios
para su actuación en estos casos.
ARTICULO 4.1.-La resolución disponiendo la confiscación de la vivienda o local
o, en su caso, la pérdida del derecho respectivo será dictada por el Director
Provincial de la Vivienda, o por el del municipio Especial Isla de la Juventud,
dentro del término de siete días hábiles contados a partir de la fecha en que
haya tenido conocimiento del hecho.
2.-Contra la resolución a que se refiere el apartado anterior sólo procederá
revisión ante el Presidente del Instituto Nacional de la Vivienda. La revisión
deberá interponerse dentro de los tres días hábiles siguientes a la fecha de
notificación de la resolución impugnada sin que ello interrumpa la ejecución de
la medida confiscatoria.
3.-Contra la resolución que dicte el Presidente del Instituto Nacional de la
Vivienda resolviendo la revisión no procederá reclamación alguna en lo
administrativo ni en lo judicial.
ARTICULO 5.-En el acto de ejecución de lo dispuesto en el artículo anterior, las
Direcciones de la Vivienda serán asistidas por la Policía Nacional
Revolucionaria, a los efectos de preservar el orden público.
ARTICULO 6.-A los efectos de lo dispuesto en este Capítulo, se entiende por
vivienda la casa que sirve de morada, permanente o temporal, así como los
locales cerrados que la integran, y los espacios, azoteas, patios y jardines
cercados, contiguos a ella o con acceso a su interior.
CAPITULO II CONFISCACION DE TIERRAS Y BIENES AGROPECUARIOS
ARTICULO 7.1.-Se dispone la confiscación de las tierras y de los
bienes agropecuarios del propietario que:
a) cultive la planta “Cannabis Indica”, conocida por marihuana, u otras de
propiedades similares;
b) oculte, transporte o trafique cualquier tipo de drogas,
estupefacientes, sustancias sicotrópicas y otras de efectos similares.
2.-Cuando los hechos señalados en el apartado anterior se cometan por
usufructuarios de tierras, se dispondrá tanto la pérdida del derecho sobre
aquellas, como la confiscación de los bienes agropecuarios.
3.-No obstante lo dispuesto en los apartados anteriores, quedarán excluidos de
la confiscación, los bienes que sean indispensables para satisfacer las
necesidades vitales del inculpado o de los familiares a su abrigo.
ARTICULO 8.-La confiscación de la tierra y de los bienes agropecuarios, y la
pérdida del derecho de posesión de las tierras, también serán aplicables, cuando
los actos señalados en el artículo anterior se cometan por otras personas que no
sean sus titulares, siempre que la ocasión o circunstancias en que realicen
dichos actos, evidencien o hagan suponer racionalmente que son del conocimiento
de los propietarios o usufructuarios de las tierras.
ARTICULO 9.1.-Cuando los hechos enunciados en el artículo 7.1 se produzcan en el
territorio de una Cooperativa de Producción Agropecuaria, se procederá a la
privación de los derechos correspondientes del infractor, y a una fuerte
penalización económica a la cooperativa, en dependencia de la tolerancia,
negligencia, falta de vigilancia y control de la misma. 2.-Si los hechos
ocurrieran en una Unidad Básica de Producción Cooperativa, se procederá de la
forma indicada en el apartado anterior.
ARTICULO 10.1.-La resolución disponiendo la confiscación o la pérdida del
derecho a la posesión de las tierras, será dictada por el Delegado Territorial
del Ministerio de la Agricultura, dentro del término de siete días hábiles a
partir de la fecha que ha tenido conocimiento de los hechos señalados en el
artículo
7.1. 2.-Contra la resolución a que se refiere el apartado
anterior, solo se podrá acudir en revisión ante el Ministro de la Agricultura.
3.-La revisión podrá interponerse dentro de los tres días hábiles siguientes a la fecha de notificada la resolución impugnada sin que ello interrumpa la ejecución de la medida confiscatoria.
4.-Contra la resolución que dicte el Ministro de la Agricultura
resolviendo la revisión, no procederá reclamación alguna en lo administrativo ni
en lo judicial.
ARTICULO 11.-A los efectos de este Decreto-Ley, se consideran bienes
agropecuarios, los animales, las instalaciones, las plantaciones, equipos o los
instrumentos destinados a la producción agropecuaria, liquidaciones y
amortizaciones, y las viviendas.
DISPOSICIONES FINALES
PRIMERA: Lo dispuesto en el presente Decreto–Ley se aplicará sin
perjuicio de la responsabilidad penal en que pudieran haber incurrido los
infractores.
SEGUNDA: A los bienes que resulten confiscados se les dará el
destino más útil desde el punto de vista económico-social en el más breve plazo.
TERCERA: La Fiscalía General de la República, en ejercicio de las
funciones establecidas en el artículo 127 de la Constitución de la República,
procederá a supervisar y controlar la efectiva y rápida ejecución de las medidas
y trámites previstos en este Decreto-Ley.
CUARTA: Se faculta al Ministro del Interior, al Ministro de la
Agricultura y al Presidente del Instituto Nacional de la Vivienda para que, en
lo que a cada uno concierne, dicten las disposiciones o instrucciones que
resulten necesarias a los efectos del mejor cumplimiento de lo establecido en
este Decreto-Ley.
QUINTA: Se derogan todas las disposiciones legales y
reglamentarias que se opongan a lo establecido en este Descreto-Ley, el que
comenzará a regir a partir de la fecha de su publicación en la Gaceta Oficial de
la República.
DADO en el Palacio de la Revolución, en la ciudad de La Habana, a
